This Terms of Service Agreement (the “Agreement”) is made effective as of 1 July 2024, by and between Kreatology Limited and Kylie Garner (hereinafter referred to as the “HelloZen CRM™”), with its principal place of business located at Unit 1603, 16th Floor, The L. Plaza, 367 – 375 Queen’s Road Central, Sheung Wan, Hong Kong and the individual or entity (hereinafter referred to as the “User”) identified as having agreed to the terms and conditions set forth in this Agreement.
HelloZen CRM™ operates in the Marketing, Web, Automation & AI industry and offers a Monthly and Annual plan to the CRM.
HelloZen CRM™ reserves the right to cancel any membership, at any time, for any reason we consider appropriate. This decision is entirely at our discretion.
HelloZen CRM™ does not offer refunds for any paid plans under any circumstances.
By agreeing to use HelloZen CRM, you (the User) and we (HelloZen CRM) accept the following terms:
ACCEPTANCE OF TERMS: By accessing or using HelloZen CRM™’s program or services, the User agrees to be bound by the terms and conditions set forth in this Agreement. If the User does not agree with these terms and conditions, they must cease using HelloZen CRM™’s program immediately.
FREE MEMBERSHIP: HelloZen CRM™ offers a 7 Day Free Trial to all Users. This free trial is subject to the User’s compliance with HelloZen CRM™’s terms and conditions, as specified herein.
CANCELLATION OF MEMBERSHIP: HelloZen CRM™ reserves the right to cancel the User’s membership for any reason it deems appropriate, without prior notice or explanation. However, in good faith, we will endeavour where possible to give notice and offer remedy where appropriate.
DENIAL OF MEMBERSHIP: HelloZen CRM™ retains full discretion in denying the membership to anyone, at any time, without providing a reason for denial
REFUND POLICY: HelloZen CRM™ does not offer refunds for any paid plans, including the monthly or annual, under any circumstances. If you decide to dispute this charge or leave us a negative review for this reason, we will submit all documentation to show you were aware of this policy when making the purchase, not limited to the checkbox in the order form. We will not be intimidated to change our policy.
COMPLIANCE: As software resellers, we are beholden to the terms of use provided by each software we resell. This means we are obligated to do our due diligence to ensure all of our clients follow those same terms of use. For example, white label software can not be connected to domains that contain the name of the original brand. This is a misrepresentation of the brand itself. Affiliates using the brand name in the domain must include a disclaimer that you are an affiliate and not a representative of the company you are affiliated with. These terms may change at anytime as they are updated by each of the companies themselves.
INTELLECTUAL PROPERTY: The User acknowledges and agrees that all rights, title, and interest in any intellectual property related to HelloZen CRM™’s program or services (including but not limited to trademarks, copyrights, and patents) shall remain the sole property of HelloZen CRM™.
PRIVACY: We believe trust is absolute paramount in a relationship. We do not own your data, we will never sell or share your data. We also respect your right to data privacy. Our promise to you is that we will never access your account unless it is related to the provision of your services or with your express consent. And if we ever do need to enter your account, we will only access the areas relevant to the task being carried out.
TRANSFER OF ACCOUNT: If for any reason you would like to move your Sub-Account to another Go High Level Provider, make your request in writing to hello@hellozencrm.com and we will endeavour to complete the transfer within 7 days. We will not unreasonably withhold your account. However, please be aware that any custom functionality including, but not limited to, KylieGPT AI Marketing Tools, Prompt Library and custom Trainings are the property of HelloZen CRM™ and will no longer be available after you transfer. Rest assured, all of your Data, Workflows, Templates and assets as part of the core Go High Level functionality are yours and will be transferred with your account.
LIMITATION OF LIABILITY: In no event shall HelloZen CRM™ be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the program or services provided. The User expressly agrees that their use of the program is at their sole risk.
GOVERNING LAW: This Agreement shall be governed by and construed in accordance with the laws of Hong Kong, without regard to its conflicts of laws principles.
ENTIRE AGREEMENT: This Agreement constitutes the entire agreement between the Parties and supersedes all prior agreements, understandings, or proposals, whether written or oral, with respect to the subject matter hereof.
By continuing to use HelloZen CRM™’s program or services, the User acknowledges and agrees to be bound by the terms and conditions set forth in this Agreement.
IN WITNESS WHEREOF, the Parties hereto have executed this Terms of Service Agreement as of the date first above written.
